TERMS AND CONDITIONS: COURSES

PRE-ASSESSMENT FEE POLICY

The pre-assessment fee is an essential part of ensuring that you are placed in the course best suited to your English proficiency level. This fee covers:

  • A written and spoken language proficiency evaluation
  • detailed feedback on your current level.

Refunds
The pre-assessment fee is non-refundable as it compensates for the time, effort, and expertise involved in assessing your skills and providing feedback.

Credit Toward Future Enrolment

If your English proficiency level does not meet the course requirements, the pre-assessment fee can be applied as a credit toward future enrolment in one of our courses, provided you meet the necessary level.

How It Works:

  • This credit must be used within one year of the date of the initial assessment.
  • If you improve your proficiency outside of LCS English courses, a reassessment may still be required to confirm eligibility for enrolment. You will be required to pay for the reassessment.

Our goal is to support your English learning journey, whether through one of our courses or by providing clear feedback and guidance to help you prepare for future opportunities.

 PAYMENT

  1. You must make the full payment for any/all courses one (1) week before the course start date.
  2. LCS English may cancel or decline your order, in part or in whole, until it has been confirmed as a legally binding agreement.
  3. A legally binding agreement between you and LCS English is made when we have accepted your offer to buy our course. This is done by sending you an invoice and when we have received payment of the fees from you.

CANCELLATIONS AND REFUNDS

  1. You may cancel your course and receive a full refund (minus pre-assessment fee) up to one (1) week before the course start date.
  2. If a cancellation is made within seven (7) days of the course start date, no refund will be issued. However, you may apply your payment as a credit toward a future course. The future course must be completed within one year of your enrolment.
  3. Refunds can take up to a maximum of 60 days to process. This timeframe accounts for administrative reviews and bank processing times. Students will be notified once the refund process has been initiated. Refunds will be issued using the same method of payment as the original transaction unless otherwise agreed. We are committed to processing refunds as efficiently as possible and appreciate your patience during this time.
  4. After the start date of an LCS English Course, any lesson hours that are not attended, reduced, cancelled, or shortened are non-refundable.
  5. If illness prevents you from attending the course, you may request to postpone to a later date. LCS English requires a letter from your doctor to process the postponement. The letter can be submitted via email.
  6. If your assigned teacher is not present in the virtual classroom within 10 minutes of the scheduled start time, it means that there are internet issues causing the cancellation of the lesson. In such cases, the lesson will be rescheduled and added to the end of your course.

SMALL GROUP POLICY

Courses are designed for a maximum of six learners. If enrolment falls below the requisite number of six learners, LCS English reserves the right to:

  • run the course with 5 learners
  • run the course with a smaller group of 3-4 students at an adjusted fee, reflecting the added benefits of further personalised instruction.
  • defer the course to a later date
  • provide a full refund upon request.

 TRANSFER FROM ONE COURSE TO ANOTHER

  1. You may request a transfer to a different course up to one (1) week before the course begins, subject to approval.
  2. If you wish to transfer from one course to another, you must make the request via email.
  3. LCS English reserves the right to approve/disapprove your application for the transfer of your registration to another course.
  4. The transfer can only occur within one year of the registration, failing which the course fee is forfeited.

 DEFERRAL OF COURSES

  1. If you wish to defer your enrolment to a later course start date, you must submit a written request no later than one (1) week before the course begins.
  2. A deferral must occur within 12 months of the original registration.
  3. Deferral requests made less than one (1) before the course start date may be subject to an administrative fee.
  4. Access to course materials, including live sessions, recordings, lesson notes, and exercises, will be limited to enrolled learners. If a course is deferred, access will be restricted unless otherwise agreed.

ATTENDANCE AND PUNCTUALITY

  1. It is your responsibility to check your scheduled classes in the LCS English Course Dashboard. The scheduled times in the Dashboard are based on the South African time zone, day, and time (SAST).
  2. Being late for class is the same as being absent.
  3. 100% attendance is expected for these courses:
  • The Communication Essentials Toolkit: Advanced techniques for verbal and written excellence
  • Present with Confidence: English Mastery for Effective Speaking
  1. 85% attendance is expected for these courses:
  • B2 English Success Programme
  • C1 English Success Programme
  1. In the case of absenteeism, it is your responsibility to log into your account in order to catch up on classwork and homework assigned.
  2. LCS English cannot meet your expectations if you do not come to classes.

 ACCESSING THE WEBSITE AND ACCOUNT SECURITY

  1. We reserve the right to withdraw or amend this Website and any service or material we provide on the Website in our sole discretion without notice.
  2. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period.
  3. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users.
  4. To use the Website or some of its resources, you may need to provide registration details or other information. It is important that all the information you provide is accurate, up-to-date, and complete. By providing this information, you agree to our Privacy Policy and give permission for us to handle your data as outlined in that policy.
  5. If you choose, or are provided with, a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity.
  6. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Website or portions of it using your username, password or other security information.
  7. You agree to notify us immediately of any unauthorised access to or use of your username or password or any other breach of security.
  8. You also agree to ensure that you exit from your account at the end of each session.
  9. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.
  10. We have the right to disable any username, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Use.

 INTELLECTUAL PROPERTY

  1. The Website, Courses and all of the materials contained on or within them are protected by intellectual property rights.
  2. Website and Course content include, but are not limited to, the design, layout, look, appearance, graphics and documents on the Website or in our Course learning materials, as well as all other content on the Website such as (but not limited to) articles and other text, and other content of Courses such as presentations, videos, exercises, tests and diagrams.
  3. All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Website, is the property of the Company or its suppliers.
  4. You will not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Website, Courses or any of the resources available for download from the Website.
  5. LCS English content is not for resale. Your use of the Website, Courses or any of the resources available for download from the Website does not entitle you to make any unauthorised use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content.
  6. You will use protected content solely for your individual use, and will make no other use of the content without the express written permission of LCs English the copyright owner.
  7. If you have our written permission to provide these Course materials to another person, you must ensure that they are made aware of these restrictions. You may be responsible to us for that person’s non-compliance with these restrictions contained herein.
  8. By ordering or participating in Courses, you further agree that you shall not create any derivative work based upon the Courses and you shall not offer any competing products or services based upon any information contained in the Courses.
  9. We reserve the right to monitor your usage of the Course and Website content. In the event that you violate these Terms (including but not limited to in the event that you share your login details for the Course and/or Website with another person or share or publish Course content), we may, at our discretion, suspend or terminate your access to the Course. We will not provide any refund for fees.

EMAIL AND OTHER ELECTRONIC COMMUNICATIONS

  1. When you visit the Website or send emails to LCS English, you consent to receiving communications from us.
  2. Any such email or other electronic communication, however, does not create a business relationship or any contractual relationship.
  3. As set forth more fully in our Privacy Policy, we will take reasonable steps to ensure that any communication remains confidential.

USE OF COMMUNICATION SERVICES

  1. The Website and Courses may contain bulletin board services, chat areas, news groups, forums, communities, calendars, blog comment sections and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”).
  2. You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.
  3. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
  • defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
  • publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information;
  • upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents;
  • upload files that contain viruses, corrupted files, or any other similar software or programmes that may damage the operation of another's computer;

LCS English reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the LCS English’s sole discretion.
  4. Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

  1. While LCS English aims to provide high-quality English courses, specific outcomes or results cannot be guaranteed. The progress and success of each student may vary based on individual effort, dedication, and external factors.
  2. You also understand that past results do not guarantee the same outcome for everyone. Therefore, the success others have had does not guarantee that you or anyone else will achieve the same results.
  3. LCS English is not responsible for any direct or indirect damages or losses incurred as a result of using our services.

 LIMITATION OF LIABILITY

  1. You agree to absolve LCS English of any and all liability or loss that you or any person or entity associated with you may suffer or incur as a result of use of the information contained on this website, the courses and/or the resources you may download from this website.
  2. You agree that the company shall not be liable to you for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages for use of this website.
  3. The information, software, products, and services included in or available through the website may include inaccuracies or typographical errors.
  4. Changes are periodically added to the information herein. LCS English and/or its suppliers may make improvements and/or changes in the website, courses and/or resources at any time.

  1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where LCS English is registered.
  2. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

INTERNATIONAL USERS

  1. The Service is controlled, operated and administered by LCS English, which is based in South Africa.
  2. If you access the Service from a location outside South Africa, you are responsible for compliance with all local laws.
  3. You agree that you will not use the LCS English Content accessed through the Website in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
